$165,000 Awarded in Intersection Collision Case

Gene Toscano, Inc. represented a mother and her young child after their vehicle was involved in a serious broadside collision at a San Antonio intersection. The plaintiff was driving straight through a green light when a minivan traveling in the opposite direction attempted a left turn across her lane, resulting in a violent crash.

The defense claimed that the driver had control of the intersection and that another vehicle had blocked both parties’ views. However, the legal team successfully demonstrated that the defendant failed to yield the right of way and turned unsafely in front of oncoming traffic. Both vehicles were totaled, and airbags deployed.

The plaintiff suffered lower back injuries, including disc bulges at L4-5 and L5-S1. She received chiropractic care, physical therapy, and an orthopedic evaluation. Medical experts testified to the long-term effects of chronic pain and mobility restrictions. She was also advised not to lift more than 15 to 20 pounds, limiting her ability to care for her child. The child, who sustained a chest contusion, did not require long-term treatment.

Despite being brought onto the case just weeks before trial, the attorneys secured a jury verdict assigning 99 percent fault to the defendant. The jury awarded $165,100 for the mother’s damages and $135 for the child’s, resulting in a total recovery of $163,483 after minor adjustments for comparative fault.

This result provided accountability and critical financial support for a young family affected by a preventable left-turn collision.
